Constitution Petitions
The part II Chapter 1 of the Constitution of Pakistan deals with the fundamental rights of a person, right to worship and cultural and educational rights, which provides right to life and liberty, equality before law, freedom of speech and expression, liberty of thought, fair trial and right against discrimination etc
Whenever a person is affected by any illegal act or omission of public officials or of any public office, he may approach the High Court under article 199 of the constitution of Islamic republic of Pakistan or Supreme Court under article 184 of the constitution to issue the appropriate writ. However a person may approach the High Court when there is infringement of fundamental right as well as legal right although Supreme Court entertains a writ only in those cases where there is a violation of the fundamental rights. The writ petition may be invoked against private person who is acting illegal in partnership with any public authority.
